1. About MobileHealth
MobileHealth ("the Platform", "we", "us") is a booking platform that connects patients with independent caregivers, home-visit nurses, and house-call doctors ("Caregivers"). MobileHealth is not itself a healthcare provider, hospital, or medical practice, and does not employ Caregivers. Caregivers are independent professionals or service providers who register, set their own prices, and accept or decline bookings at their discretion.
2. Eligibility & Registration
You must provide accurate, current information when registering. Caregivers registering as a Nurse, Doctor, or Specialist must hold valid, verifiable registration with the Health Professions Council of South Africa (HPCSA) where applicable. MobileHealth performs reasonable verification checks but does not guarantee the ongoing accuracy of any professional's credentials, and verification does not constitute a warranty of the quality, safety, or outcome of any service rendered.
3. Bookings, Pricing & Payment
Caregivers set their own service prices. Payment for a booked visit is arranged directly between the patient and the Caregiver (e.g. collected on arrival via cash, card, or EFT, unless otherwise stated in-app) — MobileHealth does not process patient-to-caregiver payments. Caregivers pay MobileHealth a separate monthly membership fee to remain listed on the Platform, based on their registered role, as displayed at the time of registration and on the Platform's pricing page. Membership fees are billed monthly and are non-refundable except where required by law.
4. Cancellations
Patients and Caregivers may cancel or decline a booking prior to the scheduled visit. Repeated late cancellations or no-shows by either party may result in account warnings or suspension at MobileHealth's discretion.
5. Medical Disclaimer
MobileHealth does not provide medical advice, diagnosis, or treatment, and is not a substitute for emergency medical services. In a medical emergency, contact emergency services directly (South Africa: 10177) rather than booking through the Platform. Any medical advice, diagnosis, or treatment provided during a booked visit is given solely by the Caregiver, in their independent professional capacity.
6. Ratings & Reviews
Patients may rate and review completed visits. Reviews must be honest, based on genuine experience, and must not contain defamatory, abusive, or unlawful content. MobileHealth may remove reviews that violate these Terms.
7. User Conduct
You agree not to misuse the Platform, including submitting false information, harassing other users, or attempting to circumvent verification or safety processes.
8. Limitation of Liability
To the maximum extent permitted by law, MobileHealth is not liable for any injury, loss, or damage arising from a Caregiver's actions, omissions, advice, or treatment during a booked visit, or from a patient's or Caregiver's conduct. The Platform is provided on an "as is" basis without warranties of uninterrupted availability.
9. Account Suspension & Termination
MobileHealth may suspend or terminate any account that violates these Terms, provides false credentials, or poses a risk to other users, with or without notice depending on severity.
10. Governing Law
These Terms are governed by the laws of the Republic of South Africa.
11. Changes to These Terms
We may update these Terms from time to time. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
